Terms of Service

These Terms of Service ("Terms") govern your use of trytravelbuddy.com ("Travel Buddy", "the Service"). The Service is operated by Ricardo Vilela, an individual based in Portugal ("we", "us", "our"). By using the Service or paying for a plan, you agree to these Terms.

1. What Travel Buddy is

Travel Buddy is an AI-assisted travel planning service. You provide details about a trip you want to take. We generate a personalized plan that includes flight options, hotel options, day-by-day suggestions, restaurant picks, and booking links. Plans cost USD 29 per trip and are delivered to a permanent URL and emailed to you.

2. The plan is informational, not advisory

Travel Buddy outputs are generated by AI (Anthropic's Claude) combined with live data from third parties (flight and hotel search). Plans are suggestions, not professional travel, financial, medical, or legal advice. Travel conditions change. Prices, availability, restaurant hours, and local conditions can shift between when your plan is generated and when you travel. You are responsible for verifying all information before booking, paying, or acting on it.

We do not guarantee that any specific flight, hotel, restaurant, attraction, or activity mentioned in your plan will be available, open, safely accessible, or priced as shown.

3. Bookings happen with third parties, not with us

We do not sell flights, hotels, rental cars, or experiences. The booking links in your plan take you to third-party providers (Travelpayouts, GetYourGuide, Discover Cars, and others). When you book through one of these links, your contract is with that third party under their terms. We are not party to that contract and have no liability for it. Some links are affiliate links — see Section 8.

4. Payment, no refunds, EU consumer rights

Plans are USD 29, charged once via Stripe. Because each plan is a personalized digital product generated specifically for you, all sales are final and no refunds are offered once a plan has been generated.

If you are an EU consumer, you would normally have a 14-day right of withdrawal under EU Directive 2011/83/EU. By purchasing a plan, you expressly request immediate generation and delivery of digital content and acknowledge that this waives your 14-day right of withdrawal under Article 16(m) of that Directive. You will be asked to confirm this acknowledgment at checkout.

If we fail to deliver a plan you paid for, or deliver one that is corrupted, blank, or non-functional, contact hello@trytravelbuddy.com within 14 days and we will regenerate it or refund you, at our discretion.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit destinations, dates, or content intended to generate illegal, harmful, or abusive output
  • Attempt to reverse-engineer, scrape, or build a competing service from our outputs
  • Resell, republish, or sublicense generated plans without our written permission
  • Abuse the Service to consume disproportionate computational resources
  • Bypass rate limits, payment, or security controls

We may suspend or terminate access for violations without refund.

6. Intellectual property

The Travel Buddy name, branding, code, prompt design, and curated outputs are our property. You receive a personal, non-exclusive license to use a generated plan for your own travel and personal reference. You may share your plan URL with travel companions. You may not republish plans for commercial purposes or use them to train competing AI systems.

7. Accuracy of AI-generated content

The Service uses AI to generate text. AI can make mistakes. Restaurants may have closed. Hours may be wrong. A "must-try" dish may be off the menu. A neighborhood description may be outdated. Use plans as a starting point, not as ground truth. Cross-reference critical decisions (visa requirements, vaccination needs, currency restrictions, opening times, reservation policies) with authoritative sources before traveling.

8. Affiliate disclosure

Many booking links in your plan are affiliate links. If you book through them, we earn a commission from the third-party provider at no additional cost to you. This does not influence which restaurants or experiences our AI suggests, but it does mean we have a financial incentive when you book flights, hotels, rental cars, or experiences via the recommended links.

9. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available", without warranties of any kind
  • We are not liable for any travel-related losses including but not limited to: missed flights, lost reservations, food poisoning, injuries, theft, scams, weather disruptions, currency losses, visa or border issues, or anything that happens during a trip planned with our help
  • Our total aggregate liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months prior to the claim (typically USD 29)
  • This limitation does not apply to liability that cannot be excluded under applicable Portuguese or EU consumer law

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.

11. Changes to the Service or Terms

We may modify, suspend, or discontinue the Service at any time. We may update these Terms; material changes will be announced on this page with a revised "Last updated" date. Continued use after changes constitutes acceptance.

12. Termination

You may stop using the Service at any time. We may terminate or restrict your access for violations of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of Portugal. Any dispute arising from these Terms or the Service will be brought before the courts of Portugal, except that EU consumers retain the right to bring proceedings in the courts of their country of residence under applicable EU consumer protection law.
